Terms and Conditions of Sale and Website Use

These Terms and Conditions govern access to and use of the website funsex.eu, as well as purchases made through the website.

Please read these Terms carefully before using the website, creating an account or placing an order.

By placing an order, you confirm that you have read and accepted the version of these Terms made available to you before completing the purchase.

Nothing in these Terms limits or excludes any mandatory rights granted to consumers under applicable European Union, Italian or other applicable consumer protection law.

2. Scope of These Terms

These Terms apply to:

  • use of the Funsex.eu website;

  • customer accounts;

  • orders placed through the website;

  • payments;

  • delivery;

  • product use;

  • cancellations;

  • returns and refunds;

  • legal-guarantee claims; and

  • related customer support services.

Additional policies published on the website, including our:

  • Returns, Withdrawal, Refunds and Legal Guarantee Policy;

  • Privacy Policy;

  • Cookie Policy; and

  • Shipping Policy,

form part of the contractual information applicable to your purchase.

Where a specific policy and these Terms concern the same subject, the more specific policy applies, subject always to mandatory law.

3. Consumer and Business Purchases

A “Consumer” is a natural person purchasing for purposes outside their trade, business, craft or profession.

Mandatory consumer rights described in these Terms apply only where the purchaser qualifies as a Consumer under applicable law.

A person purchasing primarily for commercial, professional or resale purposes may be treated as a business customer and may be asked to provide valid business and tax information.

4. Age Requirement

Funsex.eu is intended exclusively for persons aged 18 years or older.

By accessing the website, creating an account or placing an order, you confirm that:

  • you are at least 18 years old;

  • you have the legal capacity to enter into a contract;

  • you comply with any additional age requirements applicable in your country; and

  • you are legally permitted to purchase and receive the products ordered.

We may request reasonable proof of age or identity where necessary.

We may suspend access, reject or cancel an order where we reasonably believe that:

  • the customer is under 18;

  • false age or identity information has been provided;

  • the order is being placed on behalf of a minor; or

  • completing the sale would violate applicable law.

Any personal information collected for age-verification purposes will be handled in accordance with our Privacy Policy.

5. Account Registration and Security

You may be required to create an account to access certain functions.

You are responsible for:

  • providing accurate and current information;

  • keeping your login details confidential;

  • preventing unauthorised access to your account; and

  • notifying us promptly if you suspect unauthorised use.

You must not create an account using another person’s identity or payment information without authorisation.

We may suspend or close an account where there is reasonable evidence of:

  • fraud;

  • abusive conduct;

  • unauthorised payment activity;

  • repeated chargeback misuse;

  • unlawful activity;

  • violation of age restrictions; or

  • material violation of these Terms.

Account suspension does not affect rights or obligations arising from orders already concluded.

6. Product Information

We make reasonable efforts to ensure that product descriptions, specifications, dimensions, materials, prices and images are accurate.

However:

  • colours may appear differently depending on the customer’s screen;

  • packaging may be updated by the manufacturer;

  • minor visual differences may occur between production batches;

  • images may include decorative items not supplied with the product; and

  • measurements may be subject to reasonable manufacturing tolerances.

The product description displayed at the time of purchase determines what is included in the order.

Where an error materially affects the main characteristics of a product, we will contact the customer before dispatch where reasonably possible.

We will not substitute a materially different product without the customer’s express agreement.

7. Product Safety and Use

Customers must read and follow all:

  • manufacturer instructions;

  • safety warnings;

  • charging instructions;

  • cleaning instructions;

  • storage requirements;

  • age restrictions; and

  • contraindications supplied with the product.

Products must be used only for their intended purpose and in accordance with the instructions.

Customers must stop using a product if it:

  • appears damaged;

  • overheats;

  • leaks;

  • produces an unusual smell;

  • causes pain, injury or an unexpected reaction; or

  • otherwise appears unsafe.

Product descriptions and information on Funsex.eu are provided for general information and do not constitute medical advice.

Customers with a medical condition, implanted medical device, allergy, pregnancy or other health concern should seek appropriate professional advice before using a product where relevant.

Nothing in this Section excludes liability or legal rights relating to defective or unsafe products.

8. Availability and Third-Party Fulfilment

Products may be stored, prepared and dispatched by third-party warehouses, wholesalers, manufacturers or dropshipping fulfilment partners located within the European Union.

The sales contract remains between the customer and ASPIRE ZONE S.R.L., even where a third party stores, packs or ships the product.

Product availability may depend on stock information supplied by fulfilment partners. Stock information may occasionally change between placement and processing of an order.

If an ordered product becomes unavailable, we may:

  • contact the customer with an updated delivery estimate;

  • offer an appropriate alternative, subject to the customer’s express acceptance;

  • cancel the unavailable item and refund the amount paid for it; or

  • cancel the affected order and issue a full refund.

No substitute will be sent without the customer’s consent.

9. Placing an Order

Products placed in a shopping cart are not reserved.

Before placing an order, the customer is responsible for checking:

  • the selected product;

  • model, colour and size;

  • quantity;

  • delivery address;

  • billing information;

  • delivery method;

  • total price; and

  • applicable policies.

By clicking the final payment or order-confirmation button, the customer submits an order that carries an obligation to pay.

After the order is submitted, an automatic acknowledgement may be sent by email.

An automatic order acknowledgement confirms that we have received the order. It does not necessarily mean that the order has been accepted.

10. Formation of the Sales Contract

The sales contract is concluded when we send:

  • a dispatch confirmation;

  • an express order-acceptance confirmation; or

  • another communication clearly confirming acceptance,

whichever occurs first.

Before acceptance, we may reject an order for legitimate reasons, including:

  • product unavailability;

  • an obvious pricing or description error;

  • failed payment authorisation;

  • suspected fraud;

  • inability to verify age or identity;

  • delivery restrictions;

  • sanctions or legal restrictions;

  • an incorrect or incomplete address; or

  • quantities indicating unauthorised commercial resale.

If payment has already been collected for an order that we do not accept, the relevant amount will be refunded without undue delay.

We will not charge a higher price than the one accepted by the customer without the customer’s express agreement.

11. Prices and VAT

Prices are displayed in euros unless otherwise stated.

Prices include VAT where VAT is legally applicable and required to be included.

Before the customer completes an order, the checkout will display:

  • the product price;

  • applicable VAT;

  • delivery costs;

  • discounts;

  • any additional charges collected by us; and

  • the total amount payable.

Delivery costs and available delivery methods may vary according to:

  • destination;

  • parcel weight;

  • parcel dimensions;

  • product restrictions; and

  • selected carrier.

The price applicable to an order is the price displayed and accepted at checkout, subject to the rules on obvious errors below.

12. Obvious Pricing and Technical Errors

Despite reasonable care, a product may occasionally be displayed with an obviously incorrect price or information due to:

  • a typographical error;

  • a data-feed error;

  • a supplier error;

  • a currency-conversion error; or

  • a technical malfunction.

Where an error is clear and objectively recognisable, we may contact the customer before dispatch and offer the choice to:

  • confirm the order at the correct price; or

  • cancel the affected item or order and receive a refund.

We will not increase the price or debit an additional amount without the customer’s express consent.

This provision does not permit us to disregard a validly concluded contract merely because the agreed price later becomes commercially inconvenient.

13. Payment

Available payment methods are displayed at checkout and may include payment cards, digital wallets and third-party payment services.

Payment must be authorised at the time indicated during checkout.

Payments may be processed by independent payment service providers. We do not normally receive or directly store complete payment-card details.

Payment service providers may carry out:

  • identity checks;

  • fraud-prevention checks;

  • payment authentication;

  • sanctions screening; and

  • payment authorisation.

We may delay acceptance or dispatch where reasonably necessary to verify a payment or investigate suspected fraud.

Marketing communications are not a condition of payment or purchase.

14. Promotions, Discounts and Gift Cards

Promotional codes and discounts:

  • must be used before their expiry date;

  • may be limited to specified products or customers;

  • may be subject to minimum-order requirements;

  • cannot normally be exchanged for cash;

  • cannot be applied retrospectively; and

  • cannot be combined unless expressly stated.

We may cancel or correct a promotion where it has been affected by a manifest technical error, fraud or misuse.

Where part of a discounted bundle is returned, the refund may be recalculated based on the price that would have applied to the retained products without the bundle discount.

Gift cards and vouchers are governed by any specific terms presented when they are purchased or issued.

Nothing in this Section limits statutory rights.

15. Order Processing and Dispatch

Orders may enter automated fulfilment shortly after payment.

Processing times shown on the website are estimates unless expressly stated as guaranteed.

An order may be dispatched:

  • from one or more fulfilment locations;

  • in multiple parcels;

  • through different carriers; or

  • on different dates.

The customer will not be charged additional delivery fees solely because we divide an order into multiple parcels.

The customer will receive shipping information where tracking is available.

16. Delivery

Delivery estimates are not guaranteed unless the website expressly identifies a delivery date or service as guaranteed.

Unless a different delivery period has been agreed, goods will be delivered within the period required by applicable consumer law.

We remain responsible for performing the sales contract even where delivery is carried out by a third-party carrier or fulfilment provider.

The customer must provide a complete and accurate delivery address.

We are not responsible for delays or additional costs caused by:

  • an incorrect or incomplete address supplied by the customer;

  • refusal to provide information reasonably required for delivery;

  • repeated absence of the recipient;

  • failure to collect the parcel; or

  • delivery restrictions not disclosed by the customer.

This does not affect the customer’s rights where the delay or failure is attributable to us, our carrier or our fulfilment partner.

Where delivery is materially delayed, the customer may exercise the remedies provided by applicable law, including setting an appropriate additional delivery period where required.

17. Passing of Risk and Delivery Evidence

Risk of loss or damage passes to the Consumer when the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the goods.

Where the Consumer independently appoints a carrier that was not offered by Funsex.eu, risk may pass when the goods are delivered to that carrier, as permitted by law.

Carrier tracking, delivery scans, collection records, signatures, access codes, photographs and other delivery evidence may be used to investigate delivery disputes.

Such evidence may be considered together with all other relevant circumstances and does not prevent a customer from demonstrating that delivery did not occur.

18. Failed, Refused and Uncollected Deliveries

Refusing delivery or failing to collect a parcel does not by itself constitute a valid notice of withdrawal.

The customer should also notify us clearly by email or through the account order page.

Where a parcel is returned because:

  • the address supplied was incorrect or incomplete;

  • the recipient was repeatedly unavailable;

  • the parcel was not collected;

  • delivery was refused without a valid reason; or

  • delivery failed for another reason attributable to the customer,

we may deduct actual and documented additional costs for:

  • return transportation;

  • storage;

  • address correction; or

  • redelivery,

to the extent permitted by law.

We do not impose arbitrary penalties or unsupported administrative charges.

19. International Orders, Customs and Import Charges

For deliveries outside the European Union customs territory, the customer may be responsible for:

  • import duties;

  • customs charges;

  • local VAT or sales taxes;

  • brokerage fees;

  • clearance charges; and

  • other charges imposed by authorities or carriers.

Unless checkout expressly states that duties and taxes are included, these amounts are not collected by Funsex.eu and must be paid by the recipient.

The customer is responsible for checking whether the ordered products may lawfully be imported, received or used in the destination country.

We may cancel an order where legal, carrier or customs restrictions prevent shipment.

If a customer refuses or fails to complete customs clearance, any refund will be assessed after the parcel is returned or its status is documented.

We may deduct actual and documented costs caused by:

  • return transportation;

  • customs processing;

  • storage;

  • carrier charges; or

  • lawful disposal where return is impossible,

to the extent permitted by applicable law.

No automatic “no-refund” rule applies merely because customs charges were refused. Any refund or deduction will depend on the actual circumstances, recoverability of the goods and applicable law.

20. Right of Withdrawal, Returns and Refunds

Consumers may have a statutory right to withdraw from an online purchase within 14 calendar days, subject to applicable conditions and exceptions.

Detailed rules concerning:

  • withdrawal notices;

  • return deadlines;

  • return shipping costs;

  • refunds;

  • product-condition requirements;

  • hygiene-sealed products;

  • defective products;

  • transport damage; and

  • refused deliveries

are contained in our Returns, Withdrawal, Refunds and Legal Guarantee Policy.

Customers must contact Funsex.eu before returning a product and follow the return instructions provided.

Products must not be sent to this address without first submitting a return request and receiving return instructions.

Customers must not return products directly to:

  • a manufacturer;

  • a supplier;

  • the sender address shown on the parcel;

  • a foreign fulfilment warehouse; or

  • another unauthorised address.

21. Hygiene-Sealed Products

Certain sealed products may not be suitable for return for genuine health-protection or hygiene reasons once their hygiene seal has been removed after delivery.

This exception may apply to certain:

  • intimate devices;

  • sex toys;

  • products intended for intimate contact;

  • lingerie supplied with a hygiene seal or liner;

  • lubricants;

  • creams;

  • oils;

  • condoms;

  • cosmetics; and

  • sealed consumable products.

Opening an external delivery carton does not by itself remove the right of withdrawal.

The applicable exception depends on:

  • the nature of the product;

  • whether a genuine hygiene or health-protection seal was supplied; and

  • whether that seal was removed, broken, damaged or altered.

Hygiene restrictions do not remove the customer’s rights where a product is defective, unsafe, damaged, incomplete or not as described.

22. Legal Guarantee of Conformity

Products sold to Consumers are covered by the statutory legal guarantee of conformity provided by applicable law.

For new goods sold to Consumers in Italy, the statutory guarantee generally applies for two years from delivery.

ASPIRE ZONE S.R.L. remains the seller responsible to the Consumer, even where the product was:

  • manufactured by another company;

  • dispatched by a supplier;

  • stored by a third-party warehouse; or

  • shipped through a dropshipping fulfilment partner.

A product may be non-conforming where it:

  • does not correspond to its description;

  • lacks advertised characteristics;

  • is unsuitable for its ordinary purpose;

  • is supplied without required accessories or instructions;

  • does not function correctly;

  • lacks the safety, durability or compatibility reasonably expected; or

  • was supplied incorrectly or incompletely.

Where a lack of conformity is established, the Consumer may be entitled to repair or replacement without charge.

Where those remedies are impossible, disproportionate, unavailable, unsuccessful or not completed within a reasonable time, the Consumer may be entitled to a proportionate price reduction or termination of the contract, subject to applicable law.

Discounted or promotional pricing does not by itself reduce the statutory guarantee applicable to a new product.

23. Commercial Guarantees

A manufacturer or supplier may provide a separate commercial warranty.

A commercial warranty:

  • is additional to the statutory legal guarantee;

  • is governed by its own terms;

  • may contain registration or procedural requirements; and

  • does not replace or reduce the Consumer’s statutory rights against Funsex.eu.

Where a commercial warranty is offered, the relevant warranty statement or manufacturer information will determine its additional scope.

24. Limitation of Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability relating to:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • intentional misconduct or gross negligence;

  • defective or unsafe products;

  • breach of mandatory consumer rights; or

  • any other liability that cannot lawfully be excluded.

Subject to those protections, Funsex.eu is not liable for losses caused solely by:

  • use contrary to product instructions;

  • improper charging or maintenance;

  • unauthorised modification or repair;

  • use of incompatible accessories;

  • accidental damage after delivery;

  • unlawful use;

  • failure to observe warnings; or

  • circumstances attributable to the customer or an unrelated third party.

For Consumers, we are responsible for losses that are a foreseeable consequence of our breach of contract or failure to use reasonable care.

We are not responsible for purely indirect, unforeseeable or speculative losses where such exclusion is permitted by law.

Nothing in this Section affects legal remedies relating to delayed delivery, non-conforming goods, product safety or withdrawal.

25. Events Beyond Reasonable Control

We may be delayed or prevented from performing certain obligations due to events genuinely beyond our reasonable control, such as:

  • natural disasters;

  • war or civil disorder;

  • major transport disruption;

  • government restrictions;

  • widespread telecommunications failure;

  • fire;

  • major industrial action;

  • epidemic-related restrictions; or

  • interruption of essential logistics infrastructure.

We will take reasonable steps to reduce the effect of such an event and will inform affected customers where appropriate.

This Section does not remove mandatory consumer rights, including rights that arise where delivery is not completed within an agreed or legally required period.

26. Acceptable Use of the Website

You must not use the website to:

  • commit fraud or another unlawful act;

  • impersonate another person;

  • purchase on behalf of a minor;

  • submit false or misleading information;

  • introduce malware or harmful code;

  • interfere with website security;

  • scrape or extract data through unauthorised automated means;

  • attempt unauthorised access to systems or accounts;

  • infringe intellectual-property rights;

  • submit abusive, threatening or unlawful content; or

  • interfere with another customer’s use of the website.

We may restrict access where reasonably necessary to protect customers, the website, our systems or legal compliance.

27. Reviews and Customer Content

Where customers are permitted to submit reviews, photographs or other content, they must ensure that the content:

  • is based on genuine experience;

  • is accurate to the best of their knowledge;

  • does not contain unlawful, abusive or discriminatory material;

  • does not disclose another person’s private information;

  • does not infringe intellectual-property rights; and

  • does not contain malware, advertising spam or fraudulent links.

By submitting content, the customer grants us a non-exclusive, worldwide, royalty-free licence to host, reproduce, translate, format and display that content for operating and promoting Funsex.eu.

The customer retains ownership of their content.

We may moderate or remove content where reasonably necessary for legal, security or authenticity reasons.

We will not selectively suppress a genuine negative review merely because it is unfavourable.

28. Intellectual Property

The website and its content, including:

  • trademarks;

  • logos;

  • text;

  • graphics;

  • layouts;

  • photographs;

  • videos;

  • software;

  • product descriptions; and

  • design elements,

are owned by or licensed to ASPIRE ZONE S.R.L., its suppliers or the relevant rights holders.

Website content may not be copied, reproduced, republished, commercially exploited or distributed without appropriate authorisation, except where permitted by law.

Use of the website does not transfer any intellectual-property rights to the customer.

29. Third-Party Services and Links

The website may use or link to third-party services, including:

  • payment processors;

  • delivery tracking;

  • social-media platforms;

  • review services;

  • analytics tools; and

  • external websites.

Third-party services may be governed by their own terms and privacy policies.

We are not responsible for the independent content or conduct of external websites that we do not control.

This does not limit our responsibility for third parties used by us to perform the sales contract, including fulfilment and delivery providers.

30. Privacy and Cookies

Personal data is processed in accordance with our Privacy Policy and applicable data-protection law.

Depending on the processing activity, personal data may be processed because it is necessary for:

  • performance of a contract;

  • compliance with a legal obligation;

  • fraud prevention or another legitimate interest; or

  • consent, where consent is legally required.

Placing an order does not constitute consent to unrelated marketing or non-essential tracking.

Non-essential cookies and tracking technologies are used only in accordance with the choices collected through our cookie-management system and Cookie Policy.

Customers may withdraw consent where processing is based on consent, without affecting the lawfulness of processing carried out before withdrawal.

31. Electronic Communications

Order confirmations, invoices, dispatch notices, return instructions and other contractual communications may be sent electronically to the email address provided by the customer.

The customer is responsible for providing a valid email address and checking relevant folders, including spam or junk folders.

Contractual or service communications are separate from marketing communications and may be sent where necessary to manage an order or comply with legal obligations.

32. Complaints and Customer Support

Customers may submit questions or complaints to:

info@funsex.eu

Please include:

  • the order number;

  • the customer’s name;

  • a clear description of the issue; and

  • relevant photographs or supporting information.

We will make reasonable efforts to investigate and respond within an appropriate time.

Where a complaint cannot be resolved directly, we will provide information about an appropriate alternative dispute resolution body where we are legally required or have agreed to use one.

We do not make a general commitment to participate in every non-mandatory ADR procedure unless expressly agreed or required by law.

33. Governing Law and Jurisdiction

These Terms and sales contracts concluded through Funsex.eu are governed by Italian law.

However, where the customer is a Consumer residing in another country, this choice does not deprive the Consumer of mandatory protections available under the law of their habitual residence where those protections apply.

Disputes involving Consumers will be heard by the courts having jurisdiction under applicable mandatory consumer and procedural law.

Nothing in these Terms imposes the exclusive jurisdiction of the courts of Rome on a Consumer where another court has jurisdiction under mandatory law.

For disputes involving a purchaser acting exclusively for business or professional purposes, the courts of Rome, Italy, will have exclusive jurisdiction unless mandatory law provides otherwise.

34. Changes to These Terms

We may update these Terms for future use of the website or future purchases, including where necessary because of:

  • legal or regulatory changes;

  • changes to website functions;

  • changes to payment or delivery methods;

  • security requirements; or

  • changes to our business operations.

The updated version will state its effective date and will apply prospectively.

An order is governed by the version of the Terms accepted when that order was placed.

Changes published after an order is concluded do not retroactively alter that contract unless:

  • required by law;

  • expressly agreed with the customer; or

  • the change benefits the customer without reducing existing rights.

Continued browsing alone does not retroactively alter the terms of an existing purchase.

35. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited only to the extent necessary.

The remaining provisions will continue to apply where legally possible.

Mandatory legal provisions will replace any invalid provision where required.

36. No Waiver

A delay or failure by either party to enforce a contractual right does not automatically constitute a waiver of that right.

Any waiver applies only to the specific circumstance for which it was given.
